WORDPLAY Trademark - Serial Number 76212632

The Mark WORDPLAY has been registered under class 028 (serial #75059827, Registration# 2054597) on 1997-04-22 under the owner WOW Toys, Inc. (no longer existing, but previously incorporated in the state of California). As of 1996-08-05 the agent for service of process of WOW Toys, Inc. resigned with no forwarding information. In addition, the state of California has officially suspended the corporation for non-compliance (see attached proof of suspension as of Jan. 2001). There stands no trace of WOW Toys, Inc. at recorded addresses and as a suspended California corporation WOW Toys effectively no longer exists. Since WOW Toys, Inc. no longer exists and since the corporation did not transfer or sell its right to the trademark WORDPLAY prior to its suspension, there is effectively no active trademark under the name of WORDPLAY (class 028) currently in the marketplace, nor is there an existing owner. As a result, Game Development Group, Inc. wishes to invoke its right to register this mark based on current use in commerce and to concurrently register this mark for use in commerce within the entire United States.
